Brand Awakening Terms and Conditions 

 These Terms & Conditions (“Terms”) govern participation in the Brand Awakening program (the “Program”), operated by Leah Kay Enterprises LLC (“Company,” “we,” “our,” or “us”). By enrolling in and accessing the Program, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not purchase or participate in the Program.

1. Program Overview

• The Brand Awakening Program is an 8-week online educational program designed to help entrepreneurs identify a product, source suppliers, set up a Shopify store, and implement automated sales systems.

• The Program includes access to live or recorded trainings, downloadable resources, workbooks, community features (Skool group), and related materials.

• The Program is delivered entirely online. You are responsible for ensuring you have adequate internet access and technology to participate.

2. Enrollment & Payment

• Enrollment in the Program is granted only after payment in full or upon initiation of a valid payment plan.

• If you select a payment plan, you are responsible for all scheduled payments, regardless of whether you complete the Program.

• Missed or failed payments may result in removal from the Program and community access until payments are made current.

• No refunds are provided except as outlined in Section 7 (Win Your Money Back Incentive) below.

3. Access & Intellectual Property

• The Program, including all videos, slides, workbooks, frameworks, and materials, is the intellectual property of Leah Kay Enterprises LLC.

• You are granted a personal, non-transferable license to use the materials for your own business development.

• You may not share, resell, reproduce, distribute, or otherwise make available Program content to non-enrolled individuals.

• Violation of these terms may result in legal action and immediate removal from the Program without refund.

4. Community Standards

To maintain a positive and safe learning environment, you agree to:

• Engage respectfully and constructively in the Skool group and all live sessions.

• Refrain from harassment, discrimination, spam, or solicitation of other members.

• Keep all discussions and shared content confidential unless explicitly permitted.

• Failure to comply may result in removal from the community and/or Program without refund.

5. Results Disclaimer

• The Company provides education, strategies, and tools but does not guarantee specific results such as sales figures, profits, or success outcomes.

• Results will vary based on individual effort, execution, industry conditions, and external factors outside our control.

• By enrolling, you acknowledge that building a business involves inherent risks and requires independent judgment, decision-making, and implementation.

6. Technology & Access

• Access to Program materials is hosted via third-party platforms (e.g., Skool, Shopify, Zoom, etc.). The Company is not responsible for downtime, outages, or technical issues caused by these platforms.

• It is your responsibility to maintain access credentials and ensure compatibility of your devices/software with the Program.

7. Win Your Money Back Incentive

The Program offers a performance-based “Win Your Money Back” Incentive to encourage accountability and participation. To qualify, you must complete all of the following requirements:

1. Watch all Program trainings/recordings.

2. Post progress updates in the Skool group at least once per week.

3. Launch your store and generate at least $1,000 in verifiable sales within 30 days of going live (self-purchases excluded; family/friend orders acceptable if not excessive).

4. Attend a transformation session with Team Leah Kay.

5. Leave reviews on Company-designated review sites.

6. Submit all completed workbooks for associated lessons.

• Proof of completion must be submitted within 7 days of the end of your 30-day sales window.

• The Company reserves full discretion in verifying and approving submissions.

• If approved, you may choose a full refund of your Program investment OR apply the full amount as a credit toward another eligible Panther Den program.

• Refunds are not available under any other circumstances due to the digital nature of the Program.

8. Limitation of Liability

• To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages resulting from participation in the Program.

• The Company’s total liability, if any, shall not exceed the amount paid for the Program.

9. Privacy & Data

• By participating, you consent to the Company collecting and storing your name, email, and other necessary information for the delivery of the Program.

• Your data will never be sold to third parties.

• From time to time, anonymized results or testimonials may be shared for marketing purposes with your consent.

10. Modifications & Termination

• The Company reserves the right to modify, update, or discontinue parts of the Program or Incentive at any time.

• Students will be notified of material changes, but continued participation constitutes acceptance of the updated Terms.

11. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.

• Any disputes shall be resolved in the courts of Frisco, Colorado.

12. Acknowledgment

By enrolling in Brand Awakening, you acknowledge that you:

• Have read and understood these Terms & Conditions.

• Agree to comply fully with the requirements outlined herein.

• Understand that participation requires effort and implementation on your part, and results are not guaranteed.
